Privacy Policy
ParkZen will notify its users of any material changes to this Privacy Policy either through e-mail or through the Application. Continued use of the Application indicates a user’s acceptance of the Privacy Policy as amended.
Information ParkZen Collects:
ParkZen accesses a phone’s GPS information when the Application detects a significant change in motion (i.e. from walking to driving) or when a user utilizes the Application’s directions to an open spot. The Application will collect and process information about a user’s actual location while giving directions. ParkZen will not share its user’s actual location information with anyone. Users can deny ParkZen access to motion and location tracking while still being able to use the Application’s map function.
ParkZen does not require a username to use the Application and its users remain anonymous. The Application does not collect personal identifying information about its users such as names or contact information . After a parking spot is vacated the Application will alert other users of the approximate location of the vacated spot. The information collected does not identify the user, the car, or the direction of travel after a parking spot is vacated.
Uses of Information
ParkZen may utilize information collected from your phone or provided by its users for the following purposes:

to provide users with information about open parking spots nearby;

to improve the experience of all of its users. For example, ParkZen may utilize a user’s phone’s motion tracking capabilities to detect when a parking spot has been vacated;

to enhance the Application’s utility. For example ParkZen may provide information about shops and attractions in users’ vicinity, or that ParkZen believes users may find interesting;

to deliver or display location-targeted advertisements through the Application, in accordance with the section titled “Advertising Campaigns” under this Privacy Policy

to improve ParkZen’s ability to identify public parking spots;

to deliver newsletter emails or respond to users who have provided an email address through the ParkZen website. Users may unsubscribe from these emails at any time;

to create aggregated and/or anonymous data. See “How does ParkZen use aggregated information” below;

to conduct surveys and questionnaires;

to enforce the Terms of Use;

to contact you if ParkZen believes it to be necessary;

to comply with any applicable law and to assist law enforcement agencies if ParkZen has a good faith belief that ParkZen’s cooperation is mandated through proper legal procedures ;

to prevent fraud, misappropriation, infringement, or any other illegal use of the Application;

to take any legal action in case of a dispute or proceeding involving ParkZen, its users, or in relation to the Application;

Personal information that you share:
The Application is based on a community of users anonymously sharing information about their recently vacated curbside parking spots. When you use the ParkZen application, we may collect and process information about your car's parking location. ParkZen uses several technologies to determine location, including GPS and other sensors. In particular, by downloading the app users choose to share when they are leaving a curbside parking spot. This vacant curbside information may be shared both directly to the Application and to all users, by showing a ParkZen icon with the number of minutes since the spot was vacated. The content that you share to all users (vacated curbside parking spots only) is neither private nor confidential. However, your email address, first and last name, and home address will not be visible to others through any reports or user posts that you share or upload. Although ParkZen takes great measures to provide you with the best experience while using the Service, ParkZen has no control over the conduct of any individual user and disclaims any and all liability in this regard. Participating in any user's activities as a result, directly or indirectly, from using ParkZen, is entirely at the user’s own risk. ParkZen is not a party to any agreement entered into between the users in any circumstances. The user has the sole and ultimate responsibility regarding compliance with all laws, regulation or any other duty. ParkZen does not accept any liability for any loss, damage, cost or expense that you may suffer or incur as a result of or in connection with your participation in any activity or event initiated, held or conducted by a user or a third party nor in connection to any agreement between the users or third parties, including any activity or event related in any way, directly or indirectly, with the Application or the use thereof.

ParkZen requires certain types of personal information only for users that make use of the ParkZen seamless pay feature for parking payments. In order to use the ParkZen app to pay for parking in select partner locations, the users will need to provide their vehicle's license plate number, e-mail address and preferred payment details.
Meta-data ParkZen collects:
ParkZen collects information about the use of the Application. Examples of metadata include, but are not limited to: recording the frequency and scope of your use of the Application; the duration of your sessions; information about the device on which you have installed the Application; advertisements that you view or click on while using the Application; the Internet protocol (IP) address and the name of the domain that serves you to access the Application; and the geographic location of the computer system that you are using to log-in. ParkZen uses this information to better understand, operate, and maintain the features and functionality of the Service.
Information ParkZen shares with others:
ParkZen does not sell, rent or lease your personal information to third parties without your consent with the exception of the following purposes and to the extent necessary in ParkZen's good-faith discretion: If ParkZen is required, or reasonably believes that it is required by law to share or disclose your information to respond to subpoenas, court orders, requests from authorities, and other legal processes; In any case of dispute, or legal proceeding of any kind between you and ParkZen, or between you and other users with respect to, or in relation with the Application; In any case where ParkZen reasonably believes that sharing information is necessary to prevent imminent physical damage or damage to property; If ParkZen organizes the operation of the Application within a different framework, or through another legal structure or entity, or if ParkZen is acquired by, or merged into or with another entity, or if ParkZen enters bankruptcy, provided however, that those entities agree to be bound by the provisions of this Privacy Policy, with respective changes taken into consideration; For facilitating the Service and to store your data on servers located in the U.S. To collect, hold and manage your personal information through cloud based or hosting Application or a third party or a party affiliated or connected to ParkZen, as reasonable for business purposes, which may be located in countries outside of your jurisdiction, including but not limited to the United States of America. ParkZen may also share personal information with companies or organizations connected or affiliated with ParkZen, such as subsidiaries, sister-companies and parent companies. Personal information may also be shared with ParkZen's other partners and service providers to the extent necessary for them to process information for us, based on our instructions and in compliance with this policy and any other appropriate confidentiality and security measures.
Data retention and deletion:

If you would like ParkZen to delete your Account, simply delete the Application from your phone. Your location and route history is associated with your Account and your username or unique identifier generated by ParkZen (if you have chosen not to set up a username). This information is held by ParkZen for such limited period of time as is necessary in order for ParkZen to be able to provide you with the Services and the uses described in this Privacy Policy. At the end of this period of time, ParkZen will then anonymize or de-identify your historical parking data. If any of the information associated with your Account is not accurate, complete or updated, you must make all necessary changes to correct it.
How ParkZen uses aggregated information:

ParkZen may use de-identified, statistical or aggregated information collected on the Application, in a form that does not enable the identification of a specific user, by posting, disseminating, transmitting or otherwise communicating or making available such information to users of the Application, to the Application' providers, partners, and any other third party. For example, GPS information that we receive from your mobile device may be provided to City planners or private enterprises in an aggregated and/ or anonymous form to help improve the location and maintenance of curbside parking options problems. ParkZen’s use and disclosure of aggregated and/or de-identified information is not subject to any restrictions under this Privacy Policy, and we may disclose it to others without limitation for any purpose.
Cookies:
ParkZen may use cookies in the Application. Cookies are small packets of information sent by a website’s servers to your web browser and then sent back by the browser each time it accesses a website’s servers. Cookies allow ParkZen to enhance users’ experience by presetting some features. ParkZen may utilize Cookies for various other purposes including, but not limited to: collecting statistical information, verifying information in the Application, customizing the Application to users’ personal preferences, and for information security.
Advertising:
ParkZen may permit, solicit or contract certain other companies to conduct advertising campaigns on the Application. The information and advertisements that users see when accessing the Application may be targeted on the basis of geographic or contextual information which ParkZen collect from or is provided by users; as well as information received from third party partners.
If when accessing the Application users no longer wish to see targeted advertisements based on information provided by third party partners, they are able to opt out of third party targeted advertisement by following the steps given by their operating system providers at https://support.apple.com/en-us/HT202074 or https://support.google.com/ads/answer/2662922?hl=en.
When users visit a third party website from the Application that website may use cookies on your computer. The third party’s use of cookies is subject to their own privacy policies and not to this Privacy Policy. ParkZen does not endorse the content of any third party advertisements delivered through the Application. Through use of the Application, ParkZen users unconditionally acknowledge that the Company is not responsible or liable for the content or products featured in advertisements in the Application.
Information Security:
ParkZen considers information security and user anonymity to be a top priority. The Company implements procedures to minimize unauthorized access or use of information. However, these measures are unable to provide absolute assurance. Therefore, although ParkZen takes great efforts to protect your personal information, ParkZen cannot guarantee and users cannot reasonably expect that ParkZen's databases will be completely immune from any wrongdoings, malfunctions, unlawful interceptions or access, or other kinds of abuse and misuse.
